General Sales Conditions

Article 1: object

These general conditions detail the rights and obligations of the company SAS Top Clean Azur and its client in the context of the sale of the following services: cleaning of carpets, carpets, mattresses and all furnishing textiles (carpets, rugs, sofas, armchairs, chairs, tapestries, curtains, etc.).

Top Clean Azur, therefore implies the customer’s unreserved acceptance of these general conditions of sale.

Article 2: Responsibilities of the service provider

SAS Top Clean Azur is committed to doing careful work following the rules of the art.
Due to the nature of the stains, their age and the properties of certain fabrics or materials, SAS Top Clean Azur cannot guarantee the cleaning results of carpets, upholstery, rugs, etc. Likewise, SAS Top Clean Azur cannot guarantee to return a furnishing textile, sofa, rug or carpet in the exact condition or color as new.
Likewise, there may be a variation in the structure of the material, rougher fibers, loss of flexibility, for example. Some glues can either harden or leave permanent stains. Toppings are not guaranteed.

We decline all responsibility for accidents:

  • After cleaning due to wear or poor condition of the part.
  • After cleaning for certain indelible stains.
  • After cleaning for shrinkage due to texture of the carpet.
  • After cleaning for discoloration or colors of
    nuances due to the quality of the dye.
  • Following wear or poor condition of the carpets (humidity of flower pots, mold, urine, aperitif, ink, excrement, vomit, coffee, tannin, corrosive products, certain stain removers…).
  • Attack by parasites (moths cause sometimes invisible holes which during cleaning stand out and enlarge).
  • Poor quality dye as well as shrinkage due to the texture of the carpet backings, synthetic fibers which react poorly to cleaning causing felting, elongation, shrinkage or even curling, difficult to identify, not being indicated in any form or there is no maintenance code.
  • Glued back with a primer which fades when cleaned.
  • Glued, unknotted edges leading to deterioration of the edges and sometimes unraveling of the carpet or tears.

It is specified that any damage that the customer may suffer must be reported within 24 hours of the occurrence, failing which the latter is prohibited from seeking in any way the real or alleged liability of the service provider.

If applicable, the service provider will provide proof that he is regularly insured for the repair of damage for which he could be civilly liable due to the intervention of his company, specifying the amount of the guarantees.

Insurance will be requested in the event of a justified dispute, where there is real damage.
In the event of proven damage, the reimbursement amount will take into account the estimate, the insurer reserving the right to a reduction for dilapidation.

The simple fact of entrusting us with an item implies knowledge and acceptance of our general conditions and taking into account that any furnishing textile, rug or carpet brought for cleaning is considered used and therefore loses its new value.

Article 3: Price

The prices of the goods sold are those in effect on the day the order is taken. They are denominated in euros and calculated excluding taxes. Consequently, they will be increased by the VAT rate and transport costs applicable on the day of the order.

The company SAS Top Clean Azur grants itself the right to modify its prices at any time. However, it undertakes to invoice the services ordered at the prices indicated when the order is registered.

Article 4: Payment terms

Payment for orders is made:

  • either by check;
  • or by bank transfer.
Article 5: Force majeure

The liability of the company SAS Top Clean Azur cannot be implemented if the non-execution or delay in the execution of one of its obligations described in these general conditions of sale results from a case of force. major. As such, force majeure means any external, unpredictable and irresistible event within the meaning of article 1148 of the Civil Code.

Article 6: Competent court

Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law.

Failing an amicable resolution, the dispute will be brought before the Commercial Court in Antibes.
